Starting January 1, 2026, California landlord-tenant laws face significant changes, most notably requiring landlords to provide functional refrigerators and stoves in rental units (AB 628). Further 2026 updates include mandatory electronic return of security deposits (AB 414), tenant options to opt out of bundled internet fees (AB 1414), and improved credit reporting options for residents in larger buildings (AB 2747).

Key 2026 California Landlord Legal Changes
Mandatory Appliances (AB 628): Landlords must provide and maintain a working stove and refrigerator for all new or amended leases.
Security Deposit Returns (AB 414): If a tenant paid rent or a security deposit electronically, landlords must return the security deposit electronically, unless agreed otherwise in writing.
Service Bundle Opt-Out (AB 1414): Tenants must be allowed to opt out of mandatory bundled third-party services like internet, phone, or satellite.
Rent Reporting (AB 2747): Landlords with 16+ units must offer tenants the option to have rent payments reported to credit bureaus.
Disaster Protections (SB 610): Stricter rules regarding habitability, rent reductions, and repairs following natural disasters.
Domestic Violence Protection (SB 611): Landlords must change locks within 24 hours of receiving written notice from a victim of domestic violence.
Maximum Security Deposit: For most units, the security deposit cap remains at one month's rent.
Rent Increase Cap: The statewide rent cap for 2026 remains 5% plus the local cost-of-living adjustment, capped at a maximum of 10%.
These changes focus on increasing habitability standards and strengthening tenant financial protections. Landlords must update lease agreements and operational policies regarding security deposits and maintenance to stay compliant.
